„Měli jsme v devadesátkách naladěnu Evropu 2 všude, kde rádio bylo slyšet. Devadesátky byly ve znamení překotných změn ve všech oblastech a médiím se nevyhnuly rovněž. Vznik prvního soukromého rádia je od samého začátku shluk náhod, na jehož konci stojí fenomenální úspěch. Každá vzpomínka na devadesátky se musí zaznamenat, dokud si ještě něco pamatujeme. Proto jsme se do toho pustili. Není to deník ani dějepisná knížka. Jsem pyšný, že jsem mohl být součástí porevolučního kvasu, stejně jako dění u zrodu legendy. Nechceme být striktně přesní, abychom nebyli nudní, spíš popsat tu dobu z našeho pohledu. Každý z nás si pamatuje něco jiného, nějak jinak, a dohromady to dává docela zajímavý plastický obrázek. Z mejdanu na mejdan, přepudrovat obličej, a mohlo se opět vyrazit. Byla to krásná doba, o které se má mluvit ze všech úhlů pohledu. My jsme to zkusili.“

Sladký příběh

Procesný útok a obrana v CSP
Publikácia vychádza z presvedčenia, že jadrom sporového konania nie je samotná procesná forma ani personálne obsadenie súdu, ale najmä kvalita a spôsob, akým strany uplatňujú prostriedky procesného útoku a obrany. Práve v tom, čo a ako strany tvrdia, aké dôkazy navrhujú, aké námietky vznášajú, aké opravné prostriedky uplatňujú a ako využívajú (alebo zneužívajú) dispozičné oprávnenia, sa rozhoduje nielen o výsledku konkrétneho sporu, ale aj o dôvere verejnosti v civilnú justíciu ako takú. V prostredí civilného procesu formovaného Civilným sporovým poriadkom už nestačí mlčať, pasívne čakať na iniciatívu súdu, „pre istotu“ všetko všeobecne popierať alebo vo všeobecnej rovine namietať všetko, čo prichádza zo strany protivníka. Takýto prístup neobstojí v konaní, ktoré je postavené na povinnosti tvrdenia, substančnej povinnosti a dôkaznom bremene strán – strany sú povinné aktívne, konkrétne a poctivo tvrdiť rozhodné skutočnosti a niesť zodpovednosť za dôkaznú podporu svojich procesných útokov a obrany. Pre advokáta to v praxi znamená povinnosť premeniť neraz chaotický, emóciami poznačený a fragmentárny klientsky príbeh na procesne využiteľný skutkový základ, ktorý spĺňa požiadavky substanciácie a zohľadňuje pravidlá rozdelenia dôkazného bremena.
S cieľom preklenúť odstup medzi teóriou a praxou obsahuje publikácia aj praktický výstup, ktorý ilustruje možnosti priamej aplikácie prezentovaných východísk v advokátskej a súdnej praxi a môže slúžiť ako opora pri formulovaní procesných podaní a pri nastavovaní sporovej stratégie.
Ak sa zároveň stane oporou advokátom pri vedomom nesení procesných bremien, pri efektívnej procesnej stratégii a pri otvorenej komunikácii s klientom o reálnych šanciach sporu a rizikách jeho vedenia, bude naplnený aj jej primárny cieľ – podporiť profesionálne zastupovanie pred civilnými súdmi.
