Kolektivní monografie se v právněhistorickém pohledu zabývá tím, nakolik se soudy při své praxi v českých zemích v 18.–20. století řídily doslovným zněním aplikovaného právního předpisu a nakolik při rozhodování šly nad jeho rámec. Stavebný zákon – vlastníctvo bytov a nebytových priestorov V súvislosti s oddialením účinnosti zákona o výstavbe je prispôsobenie režimu Zákona č. 50/1976 Zb. o územnom plánovaní a stavebnom poriadku (stavebný zákon) a Zákona č. 200/2022 Z. z. o územnom plánovaní tak, aby boli aplikovateľné súčasne a nadväzovali na seba do nadobudnutia účinnosti Zákona o výstavbe č. 201/2022 Z. z. Primárnym podnetom na spracovanie návrhu je naliehavá požiadavka oddialiť účinnosť zákona č. 201/2022 Z. z. o výstavbe v z.n.p. v súvislosti s nepripravenosťou na spustenie povoľovacích procesov podľa novej legislatívy o výstavbe. Navrhuje sa odloženie účinnosti zákona o výstavbe o jeden rok, t. j. do 1. apríla 2025. Sekundárnym cieľom v nadväznosti na oddialenie účinnosti zákona o výstavbe je prispôsobenie režimu zákona č. 50/1976 Zb. o územnom plánovaní a stavebnom poriadku (stavebný zákon) v z.n.p. a zákona č. 200/2022 Z. z. o územnom plánovaní v z.n.p. tak, aby boli aplikovateľné súčasne a nadväzovali na seba do nadobudnutia účinnosti zákona o výstavbe. Návrh smeruje k skráteniu doby prípravy stavieb, najmä doby administratívneho posudzovania vo fáze povoľovania stavieb do nadobudnutia účinnosti zákona o výstavbe. Cieľom je urýchlene vykonať legislatívne úpravy tak, aby sa eliminovalo riziko spustenia nepripravených procesov vo výstavbe a v prechodnej dobe sa v čo najväčšej miere využili existujúce inštitúty stavebného práva, primerane prebrali aplikovateľné inštitúty navrhované zákonom o výstavbe, nenarušil sa priebeh konaní na stavebných úradoch a zároveň aby sa nezaviedla úprava, ktorá by bola v zásadnom rozpore s už schválenými predpismi, ktorých účinnosť sa navrhuje posunúť na 1. apríla 2025. Výsledkom prijatia navrhovanej zmeny bude počas platnosti stavebného zákona od 1. 4. 2024: – ponechanie výkonu pôsobnosti stavebných úradov na úrovni samosprávy na obciach, – integrácia všeobecných stavebných úradov na okresných úradoch v sídle kraja s úradom, – ponechanie začlenenia špeciálnych stavebných úradov v oblasti pozemných komunikácií, železničných dráh a civilného letectva na rezorte dopravy...

Zákon č. 148/2023 Sb., o jednotném environmentálním stanovisku je novým předpisem, jehož cílem je upravit postup a působnost správních orgánů při vydávání jednotného environmentálního stanoviska za účelem zajištění veřejného zájmu na ochraně životního prostředí jako celku a přispět k udržitelnému rozvoji při rozhodování v řízení o povolení záměru podle stavebního zákona nebo navazujícím řízení podle zákona o posuzování vlivů na životní prostředí. Jedná se o procesní předpis, od kterého se očekává zrychlení a zjednodušení dosavadního roztříštěného posuzování stavebních a jiných záměrů, ale také jeho zkvalitnění ve smyslu komplexnosti posouzení. Autoři jsou odborníky Ministerstva životní prostředí, kteří se na přípravě komentovaných předpisů podíleli. Komentář je určen jak pracovníkům orgánů ochrany životního prostředí a stavebních úřadů, tak i stavebníkům, advokátům a dalším zástupcům odborné i laické veřejnosti.
