Zmeny vo výkazoch poistného
Od 1. 3. 2022 nadobudla účinnosť novela č. 480/2021 Z. z. zákona č. 215/2021 Z. z. o podpore v čase skrátenej práce (ďalej len „zákon o podpore v čase skrátenej práce“), ktorý upravuje nový inštitút tzv. Kurzarbeit na Slovensku. Vznik tohto nového právneho predpisu ako samostatného a stabilného zákona vyplynul z priebehu ekonomickej krízy v dôsledku pandémie spôsobenej šírením ochorenia COVID-19 a tiež zo skúseností spojených s využívaním štátnej podpory vo forme tzv. „Prvej pomoci“. V súvislosti so schválenými legislatívnymi zmenami dochádza aj k úprave vykazovania preddavkov na poistné na zdravotné poistenie a vykazovania poistného na sociálne poistenia.
Kurzarbeit v praxi
Od 1. apríla 2022 budú môcť zamestnávatelia začať podávať žiadosti o podporu v čase skrátenej práce podľa zákona č. 215/2021 Z. z. na pracovné miesto zamestnanca, ktorý je v pracovnom pomere alebo v právnom vzťahu na základe zmluvy o profesionálnom vykonávaní športu. Odkazy na dva druhy žiadostí budú od apríla 2022 zverejnené na www.skratenapraca.gov.sk v časti „dokumenty“. Príslušný druh žiadosti zamestnávateľ odošle formou elektronického podania prostredníctvom Ústredného portálu verejnej správy www.slovensko.sk podpísaného oprávnenou osobou kvalifikovaným elektronickým podpisom.
Zmeny v organizácii pracovného času v doprave
V súčasnosti platný zákon č. 462/2007 Z. z. o organizácii pracovného času v doprave vytvára zákonné vymedzenie minimálnych požiadaviek pre výkon jednotlivých druhov dopravy, ustanovuje minimálne požiadavky na organizáciu pracovného času v doprave. Upravuje pravidlá týkajúce sa vykonávania cestných kontrol a kontrol dopravných podnikov ako aj pôsobnosť orgánov štátnej správy v uvedených oblastiach. Subsidiárne sa na pracovnoprávne vzťahy zamestnancov v doprave vzťahuje Zákonník práce.
Neospravedlnená absencia v práci
Vo všeobecnosti je zamestnanec povinný vykonávať prácu podľa pracovnej zmluvy a dodržiavať pracovnú disciplínu, pričom obsahom tejto povinnosti je okrem iného aj povinnosť byť na pracovisku v pracovnom čase. Ak zamestnanec nenastúpi do práce bez ospravedlnenia (napr. preukázaná pracovná neschopnosť, čerpanie dovolenky a pod.), ide o neospravedlnenú absenciu, čo znamená porušenie pracovnej disciplíny.
Zmeny vo výpočte exekučných zrážok v praxi
Zmenil sa spôsob výpočtu nepostihnuteľnej sumy, ktorá sa nesmie povinnému zraziť z mesačnej mzdy osobitne pre uspokojenie neprednostných pohľadávok a osobitne pre uspokojenie prednostných pohľadávok. Okrem toho sa zvýšila suma zvyšku čistej mzdy, pri ktorej končí tretinový systéme a pri uspokojení neprednostných pohľadávok si zamestnanec môže uplatniť ako vyživovanú osobu aj osobu v prospech, ktorej trvá výkon rozhodnutia na vymoženie pohľadávky výživného.
Predĺženie lehoty na podanie DP za rok 2021
Základná lehota na podanie daňového priznania k dani z príjmov fyzickej osoby za rok 2021 je ustanovená prostredníctvom § 49 ods. 2 zákona o dani z príjmov – t. z. do troch kalendárnych mesiacov po uplynutí zdaňovacieho obdobia (kalendárneho roka). Zákon o dani z príjmov však naďalej umožňuje predĺžiť lehotu na podanie daňového priznania k dani z príjmov a to na základe oznámenia podaného príslušnému správcovi dane do uplynutia lehoty na podanie daňového priznania podľa § 49 ods. 2 zákona o dani z príjmov.
