Ak výšku výdavku (nákladu) limituje zákon alebo jeho zahrnutie v zdaňovacom období upravuje zákon v inej výške ako osobitný predpis, preukázaný výdavok (náklad) možno zahrnúť do daňových výdavkov len v rozsahu a za podmienok ustanovených v zákone. Ak výšku výdavku (nákladu) limituje zákon výškou dosiahnutého príjmu alebo výškou príjmu z prijatej úhrady, uplatní sa výdavok (náklad) alebo jeho časť do daňových výdavkov v tom zdaňovacom období, v ktorom bol dosiahnutý príjem alebo prijatá úhrada. Aké daňové a aké nedaňové výdavky zákon o dani z príjmov vymedzuje, sa dočítate v novej publikácii. Zároveň sa skrátila lehota na vyrubenie úroku z omeškania pri úplnej úhrade nedoplatku tak, že úrok bude možné uložiť do jedného roka od konca roka, v ktorom bol nedoplatok uhradený.
