Podielové spoluvlastníctvo - Judikatúra


Podielové spoluvlastníctvo predstavuje majetkový režim, ktorý často vzniká za špecifických okolností. Značná časť jeho prípadov je založená v dôsledku dedičskej postupnosti – spolumajiteľmi určitého majetku sa teda bežne stávajú aj osoby, ktoré môžu mať veľmi rozdielne názory na to, ako by sa mala spoločná vec využiť. Už vyššie uvedené predznačuje, že spoluvlastníctvo (na rozdiel od tzv. výlučného vlastníctva) generuje až dva osobitné okruhy práv a povinností. Prvý z nich je reprezentovaný právnym postavením spoluvlastníkov voči tretím osobám; druhý (a v praxi neraz omnoho komplikovanejší) okruh sa týka vzájomných vzťahov spoluvlastníkov. Základ právnej úpravy podielového spoluvlastníctva tvorí len zopár paragrafov Občianskeho zákonníka. Možno aj to je dôvodom, prečo sú súdne spory medzi podielovými spoluvlastníkmi pomerne frekventované. Okrem konaní o jeho zrušenie a vyporiadanie patria k tým najobvyklejším napríklad spory ohľadom užívania či zhodnocovania spoločnej veci alebo konania, v ktorých sú uplatňované nároky zo zákonného predkupného práva spoluvlastníkov. Táto publikácia si kladie za cieľ poskytnúť prehľad o slovenskej a českej judikatúre týkajúcej sa otázok, ktoré sú v súvislosti s podielovým spoluvlastníctvom posudzované najčastejšie. Anastas Mikoyan
