From Occupation to Integration
After the collapse of the National Socialist regime in May 1945, France became one of four principal occupying powers in a defeated Germany. Within their zone of occupation along the Upper and Middle Rhine, French occupiers participated in the Allied project to remake German society. In the process, they confronted the long history of Franco-German rivalry in the region and their country's diminished power in the wake of World War II. From Occupation to Integration explores how French ideas about civilization and the civilizing process shaped the practice of occupation in the French Zone and the early stages of European integration. The French Zone was set apart from the other Allied zones by the occupiers' belief that Nazi "barbarism" was deeply rooted in German culture and history. In seeking to transform the Germans along their border into acceptable partners for France within a united western Europe, the French occupiers applied aspects of France's universal "civilizing" mission, adapting strategies and practices developed in the country's overseas colonies to fit a European population. The Declaration of Independence depicted Native Americans as bloodthirsty savages, and from its founding the United States aimed to expand westward by seizing Indigenous lands. While white settlers saw these conquests as victories for “true religion,” native people invoked the spirits in their own defense. Some claimed the powers of Christianity, while others drew on the English-language concept of religion to redefine their own ancestral traditions. As all sorts of people struggled to make their way within this new empire, a broad variety of new religious movements emerged. The imperatives of US empire, she argues, shaped the category and traditions of what we know as religion. Tento čtvrtý svazek ediční řady Fontes iuris romani, představující překlady základních pramenů římského práva do češtiny, navazuje na předchozí díly, které byly věnovány zákonodárnému úsilí císaře Iustiniana. Prvním z nich byla učebnice práva Institutiones vydaná roku 533 n. l. Na ni navázaly první dva díly zákoníku Digesta seu Pandectae téhož císaře, které vyšly v letech 2015 a 2019. Tento třetí a poslední díl Digest nabízí vybrané tituly z knihy 36. až 50.V tomto svazku nalezne čtenář partie zaměřené na neformální odkazy a dědění podle zákona. Dále se jedná o právní úpravu darování, nabytí držby koupené věci, dědicem nebo věci opuštěné. Značná pozornost je věnována specifickému nástroji ochrany oprávněných osob, kterým byla v římském právu interdicta, tedy příkazy či zákazy úředníků vydávané mimo soudní řízení. Následně se jedná o některé otázky spojené se soudním řízením, jako jsou procesní námitky, odmítnutí žaloby a především titul nazvaný „O závazcích a žalobách“. Zařazen je rovněž obsáhlý titul o tzv. verbálních závazcích, stejně jako úprava prominutí dluhu a zárukách, jejichž cílem bylo splnění rozsudku.Zatímco z předchozích knih byly vybrány tituly zvlášť typické, nebo takové, které mají vazbu na současnou právní úpravu, případně mohou být snad inspirující pro dnešního zákonodárce, jsou knihy 47. a 48. přeloženy celé. Římské trestní právo, které je zde upraveno, je totiž dnes tou nejméně známou částí právního řádu starověkého Říma. Kromě podrobné úpravy různých druhů krádeže, urážky na cti nebo loupeže se zde čtenář seznámí s tehdejší úpravou takových trestných činů jako vražda, volební podvody, násilí nebo falšování. V další knize jsou probrány otázky spojené s odvoláním. Poslední kniha Digest je pak věnována nejen úpravě místní správy, ale zejména se jedná o titul obsahující definice různých právních pojmů a ten, v němž nalezneme 211 právních principů, které jsou vlastně platné také dnes.Překlad je doprovázen originálním textem v latině. Jedná se o kritické vydání, a proto je český text doprovázen rozsáhlým poznámkovým aparátem (více než 3000 položek). Kniha je doplněna jmenným, místním a věcným rejstříkem. Tento překlad je prvním překladem Digest do češtiny.
